2. Service Description

ER QuickCalc is a free web calculator for Genshin Impact players. We provide:

• Energy Recharge requirement calculations based on team compositions
• Character and weapon database
• Methodology documentation and guides
• Optional cloud saves for registered users.

Monetization Model:

• The service is free to use
• Voluntary donations are accepted via Ko-fi

The service is provided "as is" without warranties of any kind (see Section 5).

3. User Responsibilities & Prohibited Uses

3.1 Acceptable Use

You agree to use ER QuickCalc only for lawful purposes and in accordance with these Terms.

3.2 Prohibited Activities

You may NOT:

• Abuse the service - Send excessive requests (rate limiting applies)
• Scrape or crawl - Use bots to harvest data (use our API instead - future)
• Reverse engineer - Attempt to access source code or backend systems
• Impersonate others - Pretend to be another user or administrator
• Upload malicious content - Viruses, malware, or harmful code
• Violate laws - Use the service for illegal activities
• Harass others - If community features are added in the future

3.3 Rate Limiting

To ensure fair usage, we may limit the number of calculations per minute/hour. Excessive usage may result in temporary IP bans.

4. Intellectual Property

4.1 Genshin Impact Content

Genshin Impact® and all related characters, weapons, artwork, and game mechanics are the exclusive property of HoYoverse Co., Ltd. (COGNOSPHERE PTE. LTD.)

ER QuickCalc is a fan-made tool and is NOT affiliated with, endorsed by, or sponsored by HoYoverse.

4.2 Fair Use Doctrine (17 U.S.C. § 107)

We use publicly available game data and images under the Fair Use doctrine of U.S. copyright law for:

• Educational purposes - Teaching players about Energy Recharge mechanics
• Transformative use - Providing calculations not available in-game
• Commentary & analysis - Analytical tools for team optimization
• Non-competitive - Complementing, not replacing, the official game

We use only the minimum assets necessary for character/weapon identification (portraits, icons, names). We do NOT reproduce: cutscenes, music, story content, or 3D models.

5. Disclaimers & Limitations of Liability

5.1 No Warranties

ER QuickCalc is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including but not limited to:

• No guarantee of accuracy or reliability
• No guarantee of uptime (we may experience downtime)
• No guarantee of data preservation (always backup your teams)
• No guarantee of compatibility with all browsers/devices

5.2 Calculation Accuracy

While we base calculations on KeqingMains research and community testing, results are approximations and may not reflect exact in-game performance due to:

• Game updates and balance changes
• Player skill and rotation execution
• Team synergy variations
• RNG (enemy particles, critical hits, etc.)

We are NOT responsible for in-game results or artifact/weapon investment decisions.

5.3 Limitation of Liability

To the maximum extent permitted by law, ER QuickCalc and its maintainers shall NOT be liable for:

• Data loss or corruption
• Service interruptions or downtime
• Incorrect calculations leading to poor in-game performance
• Third-party services (Supabase)
• Indirect, incidental, or consequential damages

Total liability is limited to the amount you paid to use the service (which is $0 USD).

6. Third-Party Links & Services

6.1 External Links

ER QuickCalc may contain links to external websites (KeqingMains, HoYoLAB, Discord, etc.). We are NOT responsible for the content, privacy policies, or practices of third-party sites.

6.2 Database

ER QuickCalc does not use an external database. All application data is stored locally within the static build. No third-party database services are involved in processing user data.

7. Service Changes & Termination

7.1 Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any feature at any time
• Change pricing (if we introduce premium features in the future)
• Update calculation formulas based on new research
• Add or remove characters/weapons based on game updates

7.2 Service Termination

We may terminate or suspend the service at any time, with or without notice, for any reason (e.g., hosting costs, legal issues, maintainer availability).

If possible, we will provide 30 days notice before permanent shutdown.

8. Indemnification

You agree to indemnify and hold harmless ER QuickCalc, its maintainers, and contributors from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Your negligence or misconduct

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of Colombia.

9.2 Dispute Resolution

If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the rules of the Center for Arbitration and Conciliation of the Chamber of Commerce of Bogotá.

Continued use of the service after changes constitutes acceptance of the modified Terms.
